Secretary of State Hillary Clinton’s expected signing of the United Nations’ Arms Trade Treaty has once again raised the question of whether the terms of a treaty can take precedence over—even nullify—the rights acknowledged and secured by the Constitution of the United States.
For decades, apostles of one-world government have endeavored to convince the American people that treaties, rather than the Constitution, embody the supreme law of the land. In 1952, Secretary of State and Council on Foreign Relations member John Foster Dulles told the American Bar Association that “Treaty law can override the Constitution.” “Treaties for example…can cut across the rights given the people by their constitutional Bill of Rights.”
But the Supreme Court has more than once decided against the propaganda of the new world order crowd. In the landmark case Reid v Covert, the Court ruled”…no agreement with a foreign nation can confer power on the Congress, or on any other branch of Government, which is free from the restraints of the Constitution.” In short, as “[the Supreme] Court has regularly and uniformly recognized the supremacy of the Constitution over a treaty,” the Constitution remains the supreme law of the land, and treaties may neither supplant nor amend it.
However, treaty articles have been willfully applied in the U.S. regardless of constitutional requirements or Supreme Court decisions. A century ago, Theodore Roosevelt signed and implemented the terms of a treaty “..for two years before the Senate acted.” He later stated that he “…would have continued it until the end of [his] term, if necessary, without any action by Congress.” Roosevelt claimed, “the Constitution did not explicitly give me power to bring about the necessary agreement with Santo Domingo. But the Constitution did not forbid my doing what I did.” (3)
Would a re-elected Obama follow Roosevelt’s example by pressing the Arms Trade Treaty on the American public? Certainly, the Eric Holder Department of Justice would have no compunction about enforcing this latest of Obama’s unconstitutional schemes to undermine the 2nd Amendment. And how could the combined might and authority of the executive branch be prevented from exploiting the terms of this document in a federal assault on the right to keep and bear arms?
The Reid Court wrote that “…an international accord that is inconsistent with the U.S. Constitution is void under domestic U.S. law, the same as any other federal law in conflict with the Constitution.” But if Barack Obama was willing to inflict the unconstitutional terms of a treaty on the American people, he would certainly be willing to ignore any Court ruling that sought to prevent it.
Though Congress has the authority to nullify a treaty legislatively and federal courts have the power to overturn any unconstitutional terms, the American public has learned that neither of these institutions can be trusted with the defense of the Constitution or the rights it secures. Should Barack Obama win re-election, it will be up to the people to defend their 2nd Amendment rights. And that could make for a very messy affair.

The Oath of Office is the lawful binder. Article 2 only specifically cites the Oath for President, but Article 6 requires an Oath of Office for ALL officers, on State & United States levels. We don't need Hillary's specific signature, because she's already bound by the Oath.
The Treaty itself doesn't need to be enacted…She's already too far deep into the Conspiracy to Commit Treason against the Oath of Office. Remember the clause in the Constitution that specifies what to do for all "high Crimes and Misdemeanors?"

I wouldn't trust the courts to nullify that treaty. The courts refuses to deal with Obama's eligibility; the courts said that Obamacare was constitutional as a tax. I wouldn't trust the Congress to impeach Obama for not faithfully protecting the Constitution. I will tell you why the UN Treaty can not, and will not, trample on our Constitutional rights.
The Second Amendment, “A well regulated militia being necessary to the security of a free state, the right of the people to keep and bear arms shall not be infringed.” was put in our Bill of Rights directly after the amendment that protects our right to freedom of speech, freedom of religion and freedom of the press because it is that important. If we ever lose the Second Amendment, the First Amendment will soon follow. So, if you think that the Second Amendment was added to ensure that we had the right to hunt or shoot for sport, you are sadly mistaken. It was added to give us the means to overthrow our own government if they become too overbearing or oppressive.
Let’s look at an excerpt from the Declaration of Independence. “We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness.–That to secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the governed, –That whenever any Form of Government becomes destructive of these ends, it is the Right of the People to alter or to abolish it, and to institute new Government”. This is the reason the Founders placed out right to “keep and bear arms” only after our rights to free speech, freedom of religion, and freedom of the press. As long as we have the Second Amendment, we will have the First.
Currently, there are more than 270 Million guns owned by citizens of the US. That means that, of the estimated 310 Million citizens, there are approximately 88 guns for every 100 people. And, these are the guns that the government knows about. Most states do not require citizens to register their guns so; I would wager that the 270 Million is a considerably low estimate. This is not to say that more than 270 Million people own a gun. A large number of gun owners own more than one gun. It is estimated that 49% of US households have guns. Again, I believe that estimate to be on the low side.
Now, should the government attempt to overstep their bounds and prohibit the citizens of this country from owning a gun, I fear that that little clause in the Declaration of Independence will come into play. “That whenever any Form of Government becomes destructive of these ends, it is the Right of the People to alter or to abolish it, and to institute new Government”.
I grew up saying the Pledge of Allegiance and singing “My Country ‘Tis of Thee” every morning. My father served in WWII, my brother served in Vietnam, and, during my 22 years of service I served in both Operation Desert Storm and Operation Iraqi Freedom. I swore an oath to “support and defend the Constitution of the United States against all enemies, foreign and domestic” and that oath only expires on my death. I, along with Millions of other gun owning, America loving citizens would die before we allow our rights to be taken away or our country to be turned into an oppressive oligarchy or dictatorship.
So, if the government wants to take our guns, they are going to have to take them by force and, many of the people who they will send out to take them feel the same way and will no doubt refuse to do so. All you have to do is look at history. Before every single oppressive dictatorship was instituted, the people were first disarmed. It will not happen here!

And if push comes to shove, I will be one who would be more than proud and happy, to stand by the men and women who would fight and die to keep America save, and free! I thought I heard not until the middle of next year if not later? What they said when they announce the cancellation of the vote was because they couldn't completely exclude our 2nd amendment rights from the treaty and probably won't be able to take another serious look at it for some time. They've been talking about this treaty for some time now. Big difference this time was the President was backing it ready to sign.
Our main concern is if oblameo retains office. If he does, he could "persuade" enough to change their position to pass the treaty, and then unlike any other president previously, he would be willing to sign it.

Nice is what got our country’s highest seat STOLEN from us in 2008, and if we continue to be “nice” and politically TOLD WHAT TO SAY, HOW TO THINK, AND WHAT TO DO, we can kiss our freedom and our country good bye! Instead we need to KICK off and KICK out this entire administration, the congress, the house, and the senate, along with the so called “news” outlets and all their buttlicking liars of Washington DC! Get rid of all of them, and try each of them for Treason, and High Crimes against the United States of America. And no sympathy for any of them. None. They have had no sympathy for us, and no interest in what we think, feel or say, so return this in spades. And use the spades to dig their graves!!!!!!!!!! The 2nd amendment is the law of the land, no treaty can top it, Once this treaty is signed by Obama, so what, he is not eligible to sign anything and I don't know why anyone is afraid to say so. His signature means nothing. Everything he signed is null and void.
