The 2008 presidential election was supposed to usher in a utopian post-racial America where race no longer has a seat at the table of national affairs; A place where once for all, Americans would have equal justice under the law. But, I guess we’ll have to wait.

The Department of Justice (DOJ) dismissal of the New Black Panther Party (NBPP) 2008 voter intimidation case flies in the face of the idea of racial equality because had the roles been reversed, the entire country would be consumed in a debate about racial injustice. Instead, it’s simply accepted as an error in judgment. In reality, the dismissal was one of the most blatant examples of racial discrimination in recent history.

Last week during a House Appropriations subcommittee hearing on the dismissal, Attorney General (AG) Eric Holder downplayed the 2008 incident when comparing it to a relative’s suffering during the civil rights movement – making the DOJ look more like the “Department of Injustice.” While he is correct in saying there really is no comparison between the 2008 incident and past atrocities, Holder’s position demands that he rise above personal bias.

Eric Holder’s Admission? DoJ “Does Not Enforce the Law on the Basis of Race”

Attorney General Eric Holder had something of a meltdown on Capitol Hill today when a Republican Congressman pressed him on his preferential treatment of the New Black Panther Party. Rep. John Culberson, R-TX, read a statement from a Democrat calling the Black Panthers’ actions the worst case of voter intimidation he had ever seen. In response, Holder huffed that, while the Panther’s nightstick-wielding threats were “inappropriate,” the assessment was demeaning to “my people.”

Perhaps more important than his admission that he does not see the American people as “his people” is a line he uttered shortly afterwards.

After Culberson cited “overwhelming evidence that your Department of Justice refuses to protect the rights of anybody other than African-Americans to vote,” Holder stated, “This Department of Justice does not enforce the law on the basis of race.”

Holder intended this as a denial, but it seems more like a Freudian admission.

After all, it is precisely what Holder’s Justice Department stands accused of, not enforcing the law on the basis of race.

Black Panther Case Reaches the Boiling Point

The Black Panther voter-intimidation scandal is approaching the boiling point on four different burners. Evidence grows that the Justice Department is using illegitimate means to keep a lid on legitimate investigations. Because his department can’t be trusted to police itself, Attorney General Eric H. Holder Jr. needs to appoint a special counsel.

On Wednesday, Judicial Watch – a private watchdog – filed a brief in its case seeking release of official memoranda, arguing that government stonewalling, “is about political interference in [Justice’s] decision-making process and [the department‘s] efforts to avoid public scrutiny of that interference”…

On Thursday night, Todd Gaziano of the U.S. Commission on Civil Rights protested, “The department doggedly continues to obstruct this investigation … Even the privileges that are recognized law (as opposed to being newly invented) are not valid against the [Civil Rights] Commission”…

On Wednesday, former Justice attorney Hans von Spakovsky, now at the Heritage Foundation, challenged the bona fides of Robin Ashton, the new head of Justice’s Office of Professional Responsibility…[V]on Spakovsky warns Ms. Ashton is “completely untrustworthy,” especially regarding allegations of improperly “rifling through confidential files and documents,” and charges Mr. Holder and other bureaucrats with directly compromising the overall OPR investigation…

In September, Justice Inspector General Glenn A. Fine announced he would examine “whether the Voting Section has enforced the civil rights laws in a non-discriminatory manner”…Today, Mr. Fine retires.. His successor will be appointed by President Obama based on Mr. Holder’s recommendation.

An Avalanche of Obama Investigations Announced

The last 24 hours have provided an explosion of new investigations into the Obama administration and its allies. National Review‘s Andrew McCarthy has called for Republicans to investigate the Justice Department’s racial discrimination. The FBI and the Labor Department announced today they are investigating Andrew Stern, the head of the Service Employees International Union (SEIU), for financial improprieties. Rep. Jim Clyburn, D-SC, is warning fellow Democrats that a new Republican Congress will investigate Barack Obama’s birth certificate and eligibility. Lt. Col. Robert “Buzz” Patterson told NewsMax that Obama bundler Jodie Evans could (and should) be tried for treason. And Rep. James Sensenbrenner, R-WI, today considered keeping open a House select committee to investigate climategate. (Rep. Darrell Issa also pledged to investigate this and many other crimes in the new year.) At a minimum, this confluence of coverage demonstrates the gravity of the charges and abundance of the need for increased scrutiny and potential legal action.
